The International Baby Whisperer Terms and Conditions

The International Baby Whisperer only undertakes business on the following legally and binding Terms and Conditions.

The Contract is between the Company (The International Baby Whisperer) and the Client. Upon confirming the engagement of a Maternity Professional, after introduction by the Company, the Client agrees to enter into and accept the Terms of this Contract.

  • The Terms and Conditions are binding unless otherwise agreed in writing by a Director of the Company.
  • There is an initial, non refundable, one off Registration Fee.
  • When the Company takes your booking and starts to send you suitable applicants the booking cannot be changed unless there are extenuating circumstances.
  • The Client will be charged a Booking Fee upon confirmation of booking any of the Company services.
  • All fees must be paid in Pounds Sterling by a Bank Transfer at the time of booking.
  • Should the Client wish to book further professional services then additional Booking and Placement Fees are payable.
  • The Booking Fee to the Company for a professional is for the duration of the initial booking.  Any future dates will incur a further charge and the Company must be notified of such an event by the Client. The Booking Fee would not be payable but the nightly/24 hour Placement Fee will be chargeable.
  • The Client will only make an offer of work through the Company.
  • The Company Booking and Placement fees are not refundable. If unforeseen circumstances on the part of the Client or the Maternity Professional arise prior to or during the booking and these result in the cancellation or early termination of the booking, the Company will offer a free replacement for the remainder of the booking, unless the early termination of the booking is due to a breach of contract by the Client or a change in job description or other previously agreed elements such as pay, location and hours.
  • Should the Client wish to cancel the booking prior to the commencement date, 50% of the agreed fee for the duration of the booking will be charged to cover the Company’s loss of earnings.
  • Should the Client wish to cancel during the booking, the Company reserves the right to retain 100% of all Fees  (nightly or 24 hour fee of £25).
  • The Company will not be held responsible for any loss or damage incurred directly or indirectly as a result of an act or omission by any Company Professional.
  • The Company reserves the right to use its own discretion with regards to any situation or problem not itemised in its terms.

The International Baby Whisperer is a business which provides services to its clients. The International Baby Whisperer must process personal data (including sensitive personal data) so that it can provide these services – in doing so, The International Baby Whisperer acts as a data controller.

You may give your personal details to The International Baby Whisperer directly, such as on an application or registration form or via our website, or we may collect them from another source such as a job board. The International Baby Whisperer must have a legal basis for processing your personal data. The below information is used to provide our services to you in our capacity as a business /agency to provide services on a temporary or permanent basis based on your requirements.

Where The International Baby Whisperer has relied upon a legitimate interest to process your personal data our legitimate interests are as follows:

  • To match your requirements to assist in finding you the solutions that most suit you
  • To keep you informed of the services offered by us
  • To maintain adequate records of activity within our business

Where The International Baby Whisperer has relied on a legal obligation to process your personal data our legal obligations are as follows:

  • To deal with any medical and health and safety issues relating to certain services
  • To put in place contractual arrangements and documentation once a role has been secured

Consent

Where The International Baby Whisperer is processing your personal data based on your consent rather than any other legitimate interest, we will do so in line with our retention policy. Upon expiry of that period The International Baby Whisperer will seek further consent from you. Where consent is not granted The International Baby Whisperer will cease to process your personal data.

Recipients of data

The International Baby Whisperer may process your personal data with the following recipients:

HMRC, statutory Government departments, and other companies which may from time to time be nominated by yourself.

Contractual requirement

Your personal data is required by law or a contractual requirement (eg our client may require this personal data), or a requirement necessary to enter into a contract. You are obliged to provide the personal data and if you do not the consequences of failure to provide the data means we will not be able to represent you for work finding services and may result in incorrect payment which may not be recoverable.

2. Data retention

The International Baby Whisperer will retain your personal data only for as long as is necessary. Different laws require us to keep different data for different periods of time.

Where The International Baby Whisperer has obtained your data through consent via a direct application or a publicly enabled expression of interest via a job board for example, the data we will hold is:

  • Contact details including your address, phone number and email address

Personal data held in respect of individuals that have worked for us previously or may work for us is as follows:

  • Driving license, passport, birth certificate, marriage certificate and adoption certificate
  • Permits and visas
  • DVLA check
  • National Insurance number
  • Full details of assignments, job offers, placements and performance
  • DBS checks for certain roles
  • Medical and criminal information provided by yourself
  • References
  • Bank account details and payment history
  • Telephone, email and written communication we have had with you

 

3. Your rights

Please be aware that you have the following data protection rights:

  • The right to rectification of your personal data;
  • The right to erasure of your personal data in certain circumstances;
  • The right to restrict processing of your personal data;

  • The right not to be subjected to automated decision making and profiling; and
  • The right to withdraw consent at any time.

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.
